Terms of Service

1. Acceptance and eligibility

By installing, accessing or playing Wake Up Cat, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the game. You must be at least 13 years old. If the law where you live requires a higher age to agree on your own, a parent or legal guardian must review and accept these Terms for you.

2. Licence and ownership

We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use Wake Up Cat for lawful, non-commercial entertainment, subject to these Terms and the rules of the platform from which you obtained it. Wake Up Cat, its software, art, music, characters, trademarks and other content are owned by or licensed to Anespiem and are protected by law. Except where applicable law expressly allows it, you may not copy, sell, redistribute, reverse engineer, modify or create derivative works from the game.

3. Online service and availability

An Internet connection is required for core play, saving sessions and leaderboards. The service may change, be interrupted for maintenance, or be unavailable because of events outside our reasonable control. We aim to operate it carefully but do not promise uninterrupted or error-free availability. We may add, change or retire features where reasonably necessary; material changes will be communicated when appropriate.

4. Fair play and permitted use

Do not cheat, exploit defects, tamper with the client or protocol, submit fabricated results, use unauthorised automation, interfere with servers or other players, evade security controls, introduce malicious code, or use the service unlawfully. Security research must avoid privacy harm and service disruption and should be reported to [email protected]. We may reject scores, limit access or suspend an installation when reasonably necessary to protect players, fairness or security. You may contact support to challenge a mistake.

5. Names, scores and content

Wake Up Cat currently assigns each player a cute, localised, server-generated name; players cannot submit a custom public name or other user-generated content. Scores and that generated name may be shown on leaderboards. You remain responsible for information you voluntarily send to support and must have the right to send any attachment.

6. Advertising, purchases and refunds

The current release has no advertising or paid items. We may introduce advertising, optional digital items or services later, with updated notices and any legally required choices. Mobile purchases will be offered only through authorised billing of the official app stores. Web purchases may be processed by Xsolla. The checkout will identify the seller, price, currency and applicable terms before purchase.

Payment processing and refunds are governed by the applicable store or Xsolla terms and refund process, together with mandatory consumer law. Nothing here removes a refund, cancellation, quality or other right that cannot lawfully be excluded. Do not make a purchase through an unofficial channel claiming to sell Wake Up Cat content.

7. Third-party services

Distribution platforms, payment providers and linked third-party sites have their own terms and privacy policies. Their services are not controlled by Anespiem. Platform terms also apply when you obtain or use Wake Up Cat through that platform; if a mandatory platform term conflicts with these Terms, the mandatory platform term controls for that use.

8. Disclaimers and responsibility

Wake Up Cat is provided on an “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties and are not responsible for indirect, incidental, special or consequential loss, or loss caused by your unauthorised modification, unsupported environment or breach of these Terms. This does not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any warranty, remedy or consumer right that applicable law does not permit us to exclude or limit.

9. Ending use

You may stop using and uninstall the game at any time. We may suspend or end access for a material or repeated breach, unlawful conduct, security risk, or if the service is discontinued. Where reasonably possible, we will give notice and an opportunity to remedy a curable breach. Provisions concerning ownership, accrued payment obligations, responsibility, disputes and terms that by nature should survive will remain effective.

10. Governing law, changes and contact

These Terms are governed by the laws of Singapore, without depriving you of mandatory consumer protections available where you live. Subject to any right you have to bring a claim elsewhere under mandatory law, the courts of Singapore have non-exclusive jurisdiction. We may update these Terms for legal, security or service changes. If a change materially affects your rights, we will provide reasonable notice through the game, website or store listing as appropriate. Continuing to use the service after the stated effective date means acceptance where permitted by law; otherwise, you may stop using it.
